Making A Purchase
We accept all major credit and debit cards, including Visa and MasterCard.
Your confirmation of the order indicates that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a pricing mistake has been made or we have inadvertently under-priced goods, or we are no longer able to supply a particular product. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
TERMS & CONDITIONS
Influenza Protection Ltd (“Influenza Protection”) request that customers of our website carefully read our terms and conditions (“Terms”) prior to the use of this website and prior to ordering the antiviral medication (the “Products”) listed on our website. Our Terms govern our relationship with you in relation to this website and your order of Products from it to the exclusion of all other terms and conditions. If you have any questions about the Terms or do not wish to accept them, please email us using the Contact Us page. Please note that you may have other rights granted to you by law in addition to those set out in these Terms, which we may not exclude. These Terms do not affect those other rights granted by law.
The ordering of any Products and the access and use of this website indicates and signifies the user’s/customer’s acceptance of these Terms. All users/customers represent that he or she has read, understood, and agreed to be bound by the Terms. He or she also agrees: (a) that his or her use of the website and the order of Products is subject to all applicable international, national and local laws, (b) not to use the website and/or to order the Products for any illegal purposes, (c) not to interfere with or disrupt the website or networks connected to the website, (d) that the correct use of any Products supplied is his or her responsibility, (e) that he or she is at least 18 years old, and (f) that he or she shall only use the website and order the Products as set forth in the Terms.
CHANGES TO TERMS
Influenza Protection reserves all rights to adjust or modify the Terms, therefore a user/customer should continue to review the Terms whenever accessing or using the website. It is reasonably assumed that a user/customer’s access or use of the website after the posting of adjustments or modifications to these Terms will constitute such user/customer’s acceptance of the Terms, as modified or adjusted. Refusal by a user/customer to accept the Terms may result in the facility of the use of the website and/or ordering of the Products being withdrawn from the user/customer.
USE OF PRODUCT
You must read all Product packaging and the ‘Package Leaflet: Information for the user’ prior to using the Product. Please contact your doctor or medical advisor if you are unsure about whether you should use the Product.

PLACING AN ORDER
Once you have completed compiling your order, you will be asked to confirm that it is correct. If it is not correct, you can revisit your order and correct the mistakes before confirming and submitting your order to us. It is your responsibility to ensure that your order is correct before submitting it to us. If you have any problems with your order, please email us using the Contact Us page. When you submit your order, you are offering to order the Products at the price set out in the order. We will acknowledge receipt of your order by email. This is not an acceptance of your order. The contract between us is not formed until we confirm that we have accepted your order. When the order is accepted by us a contract is formed (the “Contract”). If you discover that you have made a mistake with your order please contact us immediately. Please do this before we confirm your order. Since the Products are personalised, Contracts are not subject to cancellation except with our express written consent.
PROCURING THE PRODUCTS
After a Contract is formed, we shall use reasonable endeavours to procure purchase of the Products on your behalf from our pharmaceutical partner and to procure that the Products are then supplied to you by our pharmaceutical partner. If, despite our reasonable endeavours, we are unable to procure the purchase of the Products and deliver of the Products for you, we will cancel the order and terminate the Contract and issue you with a full refund.
DELIVERY
It is your responsibility to ensure that the delivery destination provided to us in the order is suitable to accept delivery. In the circumstances where delivery has been attempted but has not been made, the Products will be deemed to have been delivered on the due date.
Any delivery date provided in respect of the Products is approximate only. We will use reasonable endeavours to procure that the Products are delivered within the time estimate provided to you, however, if despite those endeavours we are unable to procure delivery during the time estimate provided, we will not be in breach of the Contract and will not have any liability to you for any direct, indirect or consequential loss howsoever caused by any failure or delay in delivery. Any delay in delivery will not entitle you to cancel the Contract unless and until you have given 14 days’ written notice to us requiring delivery to be made and we have not procured delivery within that period. If you do cancel the Contract in accordance with this paragraph then we will refund to you any sums which you have paid to us in respect of that Contract or part of the Contract that has been cancelled.
OWNERSHIP
Ownership of the Products will not pass from our pharmaceutical provider to you until we have received in full all sums due to us.
ORDER PRICE
Prices on our website are checked regularly. However, if we find the price has changed when we receive your order we will contact you and ask if you wish to proceed. If you confirm that you do wish to proceed, please remember that we will still not be under an obligation to procure the supply and delivery of the Products until we have confirmed that we have accepted your order.
PRICING ERRORS
While Influenza Protection undertakes every endeavour to ensure that all prices on Influenza Protection's website are accurate, errors may occur. On discovery of a pricing error Influenza Protection will inform you as soon as is practically possible and offer you the option of reconfirming your order at the corrected price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid, you will in turn receive a full refund.
YOUR RIGHT TO CANCEL
If you are a consumer (i.e. you are not purchasing either wholly or in part for your business or you are not a business) you have the right, in addition to your other rights, to cancel the Contract and receive a refund from us. You must inform us in writing if you wish to cancel within seven working days, starting on the day after the Products are delivered by our pharmaceutical partner to you.
If you choose to cancel then you must return the Products to our pharmaceutical partner (at the address stated in the ‘Returns Policy’ section below) at your cost and risk and we advise you to ensure the Products are adequately insured during the return journey. You must ensure that you take reasonable care of the Products while they are in your possession.
FORCE MAJEURE
We will not be liable to you in any manner for any failure or delay or for the consequences of any failure or delay in the performance of any Contract if it is due to any event beyond our reasonable control including strikes, lockouts or other industrial disputes, acts of God, war, protests, fire, flood, storm, tempest, explosion, an act of terrorism, riot, epidemic, pandemic, civil commotion, national emergencies, breakdown of plant or machinery. If the event causing our delay continues for a period in excess of two months then either you or we will be entitled to terminate the Contract by notice and our only liability to you will be to refund all sums paid under the Contract in respect of the services that have not been provided to you.

LIABILITY
These Terms do not exclude our liability (if any) to you for personal injury or death resulting from our negligence, fraud, or any matter which it would be illegal for us to exclude or to attempt to exclude our liability. Influenza Protection are only liable to you for losses which you suffer as a result of a breach of these Terms by us. Influenza Protection are not responsible to you for any losses which you may incur which were not a foreseeable consequence of Influenza Protection breaching these Terms, for example if you and we could not have contemplated those losses before or when we enter into a Contract. Influenza Protection’s liability to you shall not in any circumstances include any business losses that you may incur, including but not limited to lost data, lost profits or business interruption.
MISCELLANEOUS
All communications between us will be conducted in the English language.
Other provisions that govern the use of this website and the ordering of Products are set forth in the online descriptions and notices and individual documents retrieved from the website (collectively, the "Additional Terms"), all of which are incorporated by reference into these Terms.
The failure of Influenza Protection or any third party supplier of materials and/or goods to enforce any provision hereof shall not constitute or be construed as a waiver of such provision or of the right to enforce it at a later time.

RETURNS POLICY
Other than as provided in these Terms, returned Products are only accepted for refund
or replacement in the case of split/broken capsule packaging upon receipt and due
